Court of Appeal sitting in Abuja has affirmed Governor David Umahi of Ebonyi State as the senatorial candidate of the All Progressives Congress (APC) for Ebonyi South senatorial district.
The court on Friday the court dismissed an appeal by Ann Agom-Eze and set aside the judgement of the Federal High Court and all its orders.
It held that the high court was wrong for upholding Agom-Eze’s Counter-affidavit and failed to uphold the primary election of 9th June, 2022, which produced Umahi as the APC senatorial candidate.
The court held that the governor’s nomination was never challenged within 14 days as prescribed by section 285(9) of the 1999 Constitution.
The high court had recognised Mrs Ann Agom-Eze who placed second in the May 28 primary election as the candidate but ordered a re-run of the election within 14 days.
Umahi had emerged winner of the June primaries, polling 268 of the 275 votes cast, but his victory was challenged in court.
