AGF Fagbemi clarifies Presidential prerogative of mercy exercise still under review

The Attorney-General of the Federation and Minister of Justice, Prince Lateef Fagbemi (SAN), has clarified that no inmate has yet been released under the recent Presidential Prerogative of Mercy exercise, as the process is still undergoing final administrative review.

In a statement issued on Thursday, Fagbemi explained that the ongoing review is part of the standard procedure designed to ensure that all names and recommendations comply fully with legal and procedural requirements before any instrument of release is issued.

According to him, the final stage of the clemency exercise, which comes after approval by the Council of State, involves the issuance of official instruments authorizing the release of beneficiaries. This step, he noted, allows for a “final look at the list for remedial purposes, if any,” before forwarding it to the Controller-General of Corrections for necessary action.

“The verification process is part of the standard protocol and reflects the government’s commitment to transparency and due diligence,” the Attorney-General stated.

Fagbemi emphasized that there is no delay in the process, noting that it is proceeding strictly in accordance with the law to ensure that only those who are duly qualified benefit from the President’s mercy.

“There is no delay in the process; it is simply following the law to the letter to ensure that only those duly qualified benefit from the President’s mercy. As soon as all legal and procedural checks are concluded, the public will be duly informed. The rule of law does not rush; it ensures fairness,” he said.

The AGF also commended Nigerians for their vigilance and constructive engagement on the matter, describing public interest in the process as a positive reflection of citizens’ concern for justice and good governance.

He reiterated that the Federal Government remains committed to due process, transparency, and fairness in the implementation of the Presidential Prerogative of Mercy.
