The Federal High Court in Uyo, Akwa Ibom State, has cancelled the state’s All Progressives Congress governorship primary conducted on May 26, 2022, and ordered another governorship primary be conducted within 14 days.
The court also ordered the Independent National Electoral Commission not to recognise Akanimo Udofia as candidate according to section 77 sub-section 3 of the Electoral Act.
In a suit number FHC/UY/144/2022, a former aide to President Muhammadu Buhari, Senator Ita Enang, had told the court that the party primary reportedly won by Udofia was characterized by illegalities even he noted the winner was not a member of of the party.
But Udofia, in his argument, said that the APC had given him a waiver that qualified him to contest the party primary.
Delivering judgment on Monday, November 14, 2022, the presiding judge, Justice Agatha Okeke, nullified the election and disqualified Udofia from participating in a fresh primary, saying that he was not a member of the APC in the state.
