It’s unconstitutional to appoint Minister of State, Keyamo tells Buhari

The outgoing Minister of State for Labour and Employment, Festus Keyamo, SAN, yesterday told President Muhammadu Buhari that it was an aberration to appoint a minister of state.

Keyamo stated this in his speech at the valedictory session presided over by President Buhari to mark the end of the Federal Executive Council, FEC, under his (Buhari) administration, at the Council Chamber, Presidential Villa, Abuja.

The Minister of State, who thanked President Buhari for enriching his curriculum vitae, through the appointment, noted that some other ministers of state had been grumbling and unable to be bold and speak out.

He said it would be difficult to assess the individual performances of the ministers of state since their discretion was shackled under that of the ministers as any original ideas developed by the minister of state was subject to clearance by another colleague in the cabinet before they could sail through for consideration by the council.

His prepared speech read: “Mr President, you first appointed me as Minister of State in the Ministry Niger Delta Affairs in August 2019 and you later redeployed me as Minister of State in the Ministry of Labour and Employment.

“Today, I cannot find the words to express the depth of my gratitude to you for finding me worthy, out of over two hundred million Nigerians, to be nominated and subsequently appointed to serve as a Minister of the Federal Republic of Nigeria. My curriculum vitae has been greatly enhanced – forever.

“From my very humble beginnings in a small dusty town in Delta State where I was born and raised by my struggling parents, all the way to the Council Chambers at the Presidential Villa where I had the honour and privilege to participate weekly in decision-making for my country in the last four years, it has been like a fairy tale. I give God all the glory.

“What I am about to say, therefore, is not and should not be construed as an indication of ingratitude. Far from it. What I am about to say is just my own little contribution to our constitutional development as a relatively young democracy and to aid future governments to optimize the performance of those they appoint as Ministers.

“Mr. President, the concept or designation of “Minister of State” is a constitutional aberration and is practically not working for many so appointed. Successive governments have come and gone and many who were appointed as Ministers of State have not spoken out at a forum such as this because of the risk of sounding ungrateful to the Presidents who appointed them. However, like I said earlier, this is not ingratitude.

“As a private citizen, I am on record to have gone to court a number of times to challenge unconstitutional acts of governments for the sake of advancing our constitutional democracy, so it will be out of character for me to have gone through government and be carried away by the pomp of public office and forget my role as a member of the inner bar and my self-imposed role over the years as a crusader for democracy and constitutionalism.”

Supporting his position with the provisions of the 1999 Constitution (as amended), Keyamo said: “Mr. President, I crave your indulgence to explain this constitutional conundrum of “Minister of State”. Sections 147 and 148 of the 1999 Constitution of the Federal Republic of Nigeria (as amended), deal with the appointments and responsibilities of Ministers of the Federation. The said sections state as follows:

Section 147

“(1) There shall be such offices of Ministers of the Government of the Federation as may be established by the President.
(2) Any appointment to the office of Minister of the Government of the Federation shall, if the nomination of any person to such office is confirmed by the Senate, be made by the President.

(3) Any appointment under subsection (2) of this section by the President shall be in conformity with the provisions of section 14(3) of this Constitution:- provided that in giving effect to the provisions aforesaid the President shall appoint at least one Minister from each State, who shall be an indigene of such State.”
Section 148

“(1) The President may, in his discretion, assign to the Vice-President or any Minister of the Government of the Federation responsibility for any business of the Government of the Federation, including the administration of any department of government.”

“Furthermore, the 7th Schedule to the 1999 Constitution provides for the Oath of Office to which each Minister must subscribe. There are no different Oaths for “Minister” and “Ministers of State”. They all take the same Oath of Office.”

“In addition to the above, the Ministers-designate appear before the Senate and are grilled and cleared as ministers, not as ministers in some instances and Ministers of State in some other instances. It is at the point of assignment of portfolios that successive Presidents then reclassified some as “Ministers of State.”

He contended that though the President had the constitutional powers to assign portfolios to his appointees, such appointments must be in line with constitutional provision.

He said, “Some may want to justify this by saying the President is given the discretion by the Constitution to assign whatever responsibility(ies) he likes to Ministers. Yes, I concede Mr President can do that, but not by a designation different from that prescribed by the Constitution.

“Simply put, it is akin to the President assigning responsibilities to the office of the Vice-President and re-designating that office as “Deputy President” under our present Constitution. That is clearly impossible. Why then should that of the Ministers be different?’’

Police reject N1m bribe from notorious Katsina car thieves

Operatives of the Katsina State Police Command have arrested two notorious car theft suspects and boldly rejected a ₦1 million bribe offered to them in an attempt to escape justice.

According to a statement by the command’s spokesperson, DSP Abubakar Sadiq, the suspects were nabbed with a suspected stolen vehicle.

Other items recovered from them include ₦1,000,000 cash, three mobile phones, a power bank, and a bunch of keys.

He said that on April 11th, 2025, at about 1500 hrs, while on a routine patrol along Birnin Kuka village, Mashi LGA, Katsina State, officers attached to Border Patrol Zone 4, Katsina, flagged down a Toyota Corolla LE, green colour, driven by one (1) Mubarak Kabir, m, age 26, and (2) Adamu Hashim, m, age 27, all of Kurna quarters, Fagge LGA, Kano State.

According to him, a preliminary investigation revealed that the said vehicle was reportedly stolen from FCT Abuja.

“The suspects then offered a bribe of one million naira (₦1,000,000) in cash to the patrol team with a view to evading justice, which the officers sternly rejected. Suspects are in custody,” he stated.

“Furthermore, the suspected stolen motor vehicle, cash sum of ₦1,000,000, three (3) mobile phones, one power bank and a bunch of keys were recovered from the suspects as exhibits.

“Investigations are ongoing to unravel the extent of the suspects’ involvement in criminal activities. Further developments will be communicated as the investigation proceeds.”

The State Commissioner of Police, Bello Shehu, commended the officers’ commitment to upholding the law and exhibiting a high level of integrity.

He further reaffirmed the commitment and dedication of the Command towards protecting the lives and property of the citizens in the state, while maintaining a high level of integrity and respect for human rights.

A source in the police department told our correspondent that Mubarak Kabir popularly known as MK is a famous car thief in Kano.

Atiku asks Tinubu to declare emergency rule on his presidency

Former Vice President and Peoples Democratic Party (PDP) presidential candidate, Atiku Abubakar, has called on President Bola Tinubu to declare a state of emergency—not on any region, but on his own presidency.

In a statement released Wednesday by his spokesperson, Paul Ibe, Atiku warned that Nigeria has descended into a “full-blown state of emergency,” citing worsening insecurity, economic hardship, and what he described as Tinubu’s disregard for governance amid mounting crises.

While President Tinubu remains in France on what the presidency described as a “working visit,” Atiku condemned the trip as frivolous, arguing that the country is in urgent need of leadership.

“On April 2, 2025, President Bola Tinubu flew out to France. Had this absurd announcement come just a day earlier, Nigerians would have dismissed it as an April Fool’s joke. But sadly, it’s no prank — just another insult to a nation pushed to the brink by a presidency that treats its citizens like fools,” the statement read.

Atiku accused the president of prioritizing overseas engagements over the lives of Nigerians, highlighting violent attacks in Plateau and Benue states, the resurgence of Boko Haram activity, and deepening poverty across the country.

It’s not just irresponsible— it’s contemptuous,” he said.According to Atiku, Tinubu has spent 59 days in France since assuming office—time he believes should have been devoted to tackling the crises at home.

“This isn’t just negligence. It’s dereliction of duty on a catastrophic scale,” the former Vice President said.

“If Tinubu had even a shred of empathy, he would cut his trip short and return immediately. A leader with an ounce of patriotism wouldn’t need to be begged to show up in times of crisis,” Atiku added.

Atiku took a swipe at Tinubu’s political handling of other domestic issues. He said, “Not a contrived political emergency like what Tinubu declared in Rivers for partisan gain — this is a national collapse. So when, exactly, will Tinubu declare a state of emergency on his own disastrous presidency?”

Serial killer surrenders to police in Kano

Kano State Police Command has announced the surrender of a 20-year-old Umar Auwal, who confessed his involvement in violent crimes, including homicides, in the state and its environs.

In a statement, the police spokesman, Abdullahi Haruna Kiyawa, said the development followed sustained raids conducted by the Command at strategic locations.

The raids were aimed at getting rid of criminals and  protecting life and property, during which Auwal decided to confess his crimes.

Auwal, popularly known as ‘Abba Dujal’, a resident of Wudil Local Government Area, confessed he had been involved in a series of culpable homicide, armed robbery, motorcycle and phone snatching etc in different parts of Kano and Jigawa states.

At Sabon Gari, Dujal said he had stabbed one ‘Boka’ to death and took his Infinix Hot 40i mobile phone, which he sold for N40,000.At Kurna Quarters, Kano, he stabbed another person to death and took his Samsung S26 phone, which he sold for N160,000.In Jigawa State, Dujal confessed to killing a man in Ringim Local Government and carting away his motorcycle, which he sold for N300,000.

Dujal is in custody of the Command’s Homicide Section, Criminal Investigation Department (CID) for detailed investigation into the veracity of his confessions and further necessary actions, Kiyawa, a Superintendent of Police (SP) said.

Commissioner of Police, Ibrahim Adamu Bakori, appreciated Umar’s decision to surrender. He urged others involved in similar crimes to also give up.

“Criminals will have no hiding place in the State. They should repent and surrender, as no stone will be left unturned in curtailing criminal activities in the State,” the CP said.
