Rivers Assembly: Court dismisses LP suit against INEC

A Federal High Court in Abuja has dismissed a suit brought forth by the Labour Party (LP) seeking an order for the Independent National Electoral Commission (INEC) to conduct a fresh election to fill seats in the Rivers House of Assembly vacated by defected lawmakers.

Justice James Omotosho ruled in favour of striking out the suit after LP’s counsel, F. I. Adariku, requested the case be withdrawn.

The LP sought the court’s intervention to compel INEC to conduct a new election for vacant seats by lawmakers who defected from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC).

However, INEC, represented by Victor Giwa, opposed the suit, labelling it frivolous and incompetent and citing it as an abuse of the court process.

Giwa contended that the LP lacked the legal standing and territorial jurisdiction to bring the action, emphasizing a pending case in a Federal High Court in Port Harcourt, which addressed the same subject matter and involved the same parties.

Upon INEC’s objection, LP withdrew the suit, prompting Adariku to seek its dismissal.

While A. S. Adisa, representing Giwa, did not contest the withdrawal, he requested a cost of N500,000.

In his ruling on May 3, later sighted on Monday, Justice Omotosho ordered LP to pay a cost of N50,000 in favor of INEC.

The suit involved several defendants, including Governor Siminalayi Fubara and numerous lawmakers.

Rivers: Fubara sets up panel to prove Wike govt

Rivers State Governor Siminalayi Fubara has announced that he will probe the government of his predecessor, Nyesom Wike.

Fubara made the announcement during the inauguration Mr. Dagogo Israel Iboroma (SAN) as Attorney-General and Commissioner for Justice at the Government House in Port Harcourt, the state capital.

His announcement his coming amid the feisty perennial political crisis rocking the State as Fubara battles Wike for the political control of the State.

Fubara served as Accountant-General of the state during Wike’s administration.

He said a judicial panel of inquiry would be set up to investigate how the affairs of governance were conducted before he assumed office on May 29, last year.

Iboroma replaced Prof. Zaccheaus Adangor, who was reassigned to Special Duties before he resigned.

Iboroma was sworn in after the screening by the three-member House of Assembly presided over by Victor Oko-Jumbo.

The governor said the Attorney-General was brought on board at a critical time to tackle the legal matters facing his administration with bravery and courage.

He said: “My brother, Dagogo Iboroma, you are going to be the brand new Attorney-General of our dear State. SSG, give him his letter, he is the Attorney-General.

“Why are we bringing you at this very critical time? We have a lot of issues around us. We believe that you are not going to be the one that when they send service to you, you go and file “nolle prosequi” (a formal notice of discontinuance) or you go and file one thing that would kill us here.

“Let me also say this. You have a big task. We will be setting up a judicial panel of inquiry to investigate the affairs of governance. So, brace up, I am not going back on it.

“Please, defend us. We know that you are going to defend us because your record is clean. You are a gentleman and peaceful. You are not a noise maker. People like you are endowed, and they have the fear of God.”

EFCC begins probe of Ikpeazu over N10bn airport contract, N118bn fraud

The Economic and Financial Crimes Commission has commenced investigations into the massive fraud
reportedly discovered by forensic auditors in the eight-year administration of the ex-Governor of Abia State, Dr Okezie Ikpeazu.
The auditors were engaged by the incumbent governor of the state, Dr Alex Otti.
The probe by the commission would cover the alleged diversion of the N10bn paid to Ferotex Construction Company for the execution of “non-existent” airport project, according to a report by an online newspaper, The Whistler.
Allegations of misappropriation of funds amounting to N118bn and violation of the public procurement laws of Abia State were part of the probe.
Already, the commission was said to have received copies of the forensic audit report prepared by KPMG Advisory Services indicting the ex-governor of financial recklessness during his time in office.
The EFCC commended the governor for submitting the report to the commission, noting that it was the first of its kind in the country.
The commission said the forensic audit report would make its assignment easy.

Ikpeazu was governor of Abia from 2015 to 2023 on the platform of the Peoples Democratic Party (PDP).

Otti was elected under the Labour Party.

But the former governor had in response through his then Commissioner for Information, Chief John Kalu, claimed that the airport funds were utilised for road projects.

THE Whistler last week exclusively reported how the government paid the sum of N10bn to Ferotex Construction Company for the execution of the controversial ‘non-existent’ Abia Airport Project.

The report had put the ex-governor and his officials on the spotlight as many Nigerians started calling on the EFCC to arrest and prosecute them for corruption.

Findings revealed that the N10bn appropriated by the state Assembly cannot be used to finance any project other than the airport project without a virement which must be duly approved by the lawmakers.

Budget Virement means the process of transferring budgeted funds from one line item to another, with the approval of the Assembly.

The report said there was no request to the state Assembly from the ex-governor for the virement of the N10bn airport fund for any road project.
